These Terms of Service (“Terms”) govern your access to and use of the website bafkconsulting.com (the “Site”), operated by BAFK Consulting LLC (“BAFK Consulting”, “we”, “us”, or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you may not use the Site.
These Terms apply to your use of the Site only. Consulting services are provided under separate written agreements signed between BAFK Consulting and the client.

2. Use of the Site

4. Consulting services
The Site presents an overview of the consulting services offered by BAFK Consulting. Any description of services, deliverables, timelines, or pricing is for informational purposes only and does not constitute a binding offer.
All consulting engagements are governed by a separate written agreement (e.g. Statement of Work or Master Services Agreement) executed between BAFK Consulting and the client. In the event of any conflict between these Terms and a signed engagement agreement, the engagement agreement controls with respect to that engagement.
5. Inquiries and communications
Submitting a contact form or sending us an email does not create a client relationship. A client relationship is established only upon mutual execution of a written engagement agreement.
6. No professional advice
The information provided on the Site is intended for general informational purposes only and does not constitute legal, financial, tax, or other professional advice. You should not act on any information from the Site without seeking advice from a qualified professional familiar with your specific circumstances.
7. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BAFK CONSULTING LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE.
In no event shall the aggregate liability of BAFK Consulting in connection with the Site exceed one hundred US dollars (USD 100). Liability under signed engagement agreements is governed by the terms of those agreements.
9. Indemnification
You agree to indemnify, defend, and hold harmless BAFK Consulting LLC and its officers, members, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable attorneys’ fees — arising out of or in any way related to (a) your use of the Site, (b) your violation of these Terms, or (c) your violation of any rights of a third party.
10. External links
The Site may contain links to third-party websites that are not owned or controlled by BAFK Consulting. We are not responsible for the content, privacy practices, or availability of these external sites and encourage you to review their terms and privacy policies.
11. Changes to the Site and Terms
We reserve the right to modify, suspend, or discontinue the Site, or any part of it, at any time without notice. We may also revise these Terms from time to time; the “Last updated” date reflects the most recent revision. Continued use of the Site after a revision constitutes acceptance of the updated Terms.
12. Governing law and jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in New Mexico, United States.
13. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid or unenforceable provision shall be replaced by an enforceable provision that most closely reflects its intent.
14. Entire agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and BAFK Consulting regarding your use of the Site, superseding any prior agreements regarding the Site.
